It has been revealed by the Royal Institute of Chartered Surveyors that property rental prices in the UK have reached their highest level in three years, as demand for rental property continues to grow. The figures show that around 39 percent more surveyors reported seeing an increase in rents than seeing a fall in the third quarter of this year.
This is the highest figure since the second quarter of 2007 according to RICS, which means that rents have now hit their highest level in three years. According to the group first time buyers are still struggling to secure the finance that they need to get onto the property ladder, and this means that there has been an increase in demand for rental properties amongst people that simply cannot afford to buy their own property in the current climate.
Around 33 percent more surveyors said that they had seen an increase in demand for rental properties during the third quarter, which was the biggest jump since 2008. However, despite the higher demand for rental property it was revealed that the number of properties coming onto the market for rent fell for the fifth quarter in a row, and this was the result of landlords struggling to get finance to expand their buy to let portfolios.
As a result of higher demand for rental properties amongst those that cannot get a mortgage to buy, and the drop in supply of rental property due to difficulties for landlords who need buy to let mortgages, RICS said that properties that were coming onto the market were being let extremely quickly, and landlords were experiencing very few difficulties when it came to getting tenants in.
Moreover, these factors were also pushing the cost of renting property up, with landlords able to set their prices higher because tenants are flocking to get into their homes. In some areas there are even bidding wars going on amongst potential tenants, with some lettings and estate agents taking sealed bids from would-be tenants over the amount of rent that they are prepared to pay over and above the asking rent in order to secure the property.

Massachusetts Mutual Life Insurance Co. is trying to sell six hotels it owns, including three in San Diego.

Three San Diego hotels that fell into foreclosure earlier this year are now up for sale as part of a portfolio of six bank-owned properties located in Southern California and Utah.

The three local hotels — the Courtyard by Marriott San Diego and Holiday

Inn Express San Diego, both in Old Town, and the Holiday Inn in downtown

San Diego — account for a little more than 500 rooms out of the 1,245 being marketed for sale.

Also being sold are hotels in Manhattan Beach, Salt Lake City and Provo, Utah.

Jones Lang LaSalle Hotels, which is selling the properties on behalf of the lender, Massachusetts Mass Mutual Life Insurance Co., noted that they can be purchased individually or as a portfolio.

The properties were returned to the lender after the owner, Sunstone Hotel Investors Inc., decided last year to default on a $246 million loan covering nearly a dozen hotels that it concluded were worth significantly less than the debt owed.

The San Clemente real estate investment trust ultimately agreed to hold onto three of the 11 hotels in return for an $83 million payment to Mass Mutual, leaving a loan balance of $163 million.

“I’m hopeful they’ll realize proceeds in excess of the $163 million and that they’ll be ahead of the game when all is said and done,” said Sunstone Chief Financial Officer Ken Cruse.

Together, the 11 hotels were not generating enough income to make the monthly loan payments, Cruse explained. Sunstone, however, decided that two of the hotels, located near the Mayo Clinic in Rochester, Minn., and a third in Los Angeles, made sense for it to retain.

Sunstone also formerly owned the W hotel in downtown San Diego, which it purchased four years ago for $96 million. It walked away from the trendy hotel after deciding it was worth much less than the nearly $85 million owed.

Hotel broker Alan Reay said he believes the hotels up for sale may well attract interest from investors.

“The hotels will be in demand as they are well located, especially the Old Town ones,” Reay said, “and there are a lot of buyers looking at this size of asset.”

“In property rentals it seems to me that many things are tilted towards the tenants, and I think the reason for that is because of the vicious slum lords that have existed in the metro area,” said Dick Kettering, a landlord in town who manages 11 residential buildings.

“Because of that, they’ve had to make these laws to protect tenants from those types of landlords, but I just don’t see that type of stuff going on here in Faribault.”

Last May, Gov. Tim Pawlenty signed the Tenant Bill of Rights into law. The bill regulates rental agreements for residential units, clarifying the rights and legal protections of renters and the duties of landlords.

“Minnesota’s renter population has increased, particularly in recent years, but Minnesota law simply hasn’t kept up with the growing need to adequately protect tenants who must negotiate contracts with landlords,” said Sen. Scott Dibble (DFL-Minneapolis), one of two legislators who authored the bill.

Key provisions of the bill include capping late rent fees at 8 percent of rent beginning Jan. 1, 2011; allowing tenants living in homes in foreclosure to stay in the property until the end of their lease or 90 days, whichever is longer; making landlords responsible to care for property left behind by tenants; subjecting landlords to penalties if they do not return the proper amount of security deposit at the end of a lease; and mandating that landlords have a clear and consistent screening process for all applicants, among others.

While all of the above provisions place increased burdens on landlords, tenants do not get off scot-free, either. The bill states that tenants who knowingly provide materially false information on rental applications can be held liable to the landlord for damages of up to $500, court filing fees and attorney fees.

But Kettering said that the provision requiring tenants to provide accurate information is largely irrelevant from the perspective of landlords.

“What is a landlord going to do? They could take the tenant to court, but chances are they aren’t going to get money out of them. So that’s why you try to rent to somebody who is a good risk in the first place.”

The effort to create a Tenant Bill of Rights was spearheaded by Homeline, a tenant advocacy association that has provided legal advice to renters for 18 years.

“Every single issue that came before the Legislature we received numerous calls about,” said Michael Dahl, public policy director for Homeline, adding that his organization received about 11,000 calls from tenants in 2009.

Dahl said that in general, landlords have been cooperative in working with Homeline and tenants to comply with the new regulations. In particular, he said that while the legislation was being developed, Homeline worked closely with the Minnesota Multi Housing Association. The MHAs 2,100 members together own or manage more than 250,000 multi family units in the state.

Stacy Dupont, manager of the 145-unit Four Seasons Apartment complex near the Faribault High School, said that her complex models the lease agreement that tenants sign on a template developed by the MHA.

Dupont said that the Tenant Bill of Rights Legislation has had no effect on her operation, as the late fees and other components of the Four Seasons rental agreements are already more tenant-friendly than required by the bill.

For instance, both Kettering and the Four Seasons said they typically only charge $25 for late rent, which is far less than the 8 percent maximum mandated by the new law.

Jason Hoffman, a Faribault-based attorney who often represents landlords who own multiple-unit housing, said that he doesn’t believe the Tenant Bill of Rights has affected the way most landlords do business in Rice County.

“For the most part, the landowners that I do business with are really good about having good policies and procedures in place and are pretty reputable,” he said.

But Ric Budahl, residential housing inspector for Faribault, said that Faribault is not immune from the tenant-landlord strife that organizations like Homeline confront every day.

Budahl said he typically receives at least two calls per month from tenants reporting issues with rental properties that have not been satisfactorily addressed by landlords.

In those cases, “I’ll contact the landlord, ask them to address the concern. [If that fails], I’ll request that the landlord do the repair,” he said.

Budahl said that he most often gets calls about older rental units where their might be problems relating to water in basements, apartment temperature, or mold growth.

But for the most part, Budahl said that Faribault landlords are cooperative when he requests that they make repairs to their rental units.

“The landlords in Faribault are doing a very good job maintaining their properties from our point of view,” he said.

While the new law may not change much for most landlords, others object to the Tenant Bill of Rights on more philosophical grounds.

Donna Hanbery, a landlord attorney who mostly works with property owners in the metro, said that she believes the new law could potentially create “administrative nightmares” for landlords.

With regard to the late fee provision, she said that “what I don’t like is that by capping [fees] at 8 percent [the law] ends up creating separate fees for people who might be similarly situated. Imagine a credit card company that had to figure out every interest rate individually.”

Though she acknowledged that most of her clients have had little trouble dealing with the new law, she said that “from my standpoint, I’m more of a free-market person. I think that people can let their pocketbook do the talking and the walking.”

“We did not need changes in law that are basically protectionist, telling people how to run their properties,” she said.

LSL found that the number of days or weeks that residential rental properties remained unrented declined by 15 percent over the course of the past year and this ended up saving private sector landlords 12 percent in potentially lost income. Approximately 65 percent of landlords responding to an LSL Property Services study indicated that void periods do not tend to exceed two consecutive weeks each year. An additional 18 percent of residential landlords noted that their typical void period this past year lasted for around four weeks. Over the past 12 months, landlords with void periods of two weeks or under lost £319 in rental income. The current average monthly rent stands at £691 per month.

Tom Entwistle, a buy-to-let specialist and the director of the LandlordZone website, noted that the high demand for properties very much works in the favour of Britain’s landlord and keeping a unit rented has much to do with offering a well-maintained, clean and appropriately priced flat or house to prospective tenants. Each neighbourhood and cross-section of tenants has different accommodation needs, so it is important for landlords to know their target clientele, especially if they are to avoid void periods.

LSL noted that the relative lack of financing options for landlords have kept the supply of properties lower than tenant demand.
